Middle East Monitor, 2 ao\u00fbt 2021. <\/strong>La Cour supr\u00eame d’Isra\u00ebl a offert aujourd’hui aux r\u00e9sidents palestiniens du quartier occup\u00e9 de Sheikh Jarrah le statut de \u00ab\u00a0r\u00e9sidents prot\u00e9g\u00e9s\u00a0\u00bb, disant que s’ils paient un loyer \u00e0 l’organisation de colons qui revendique le terrain sur lequel leurs maisons sont construites, leurs propri\u00e9t\u00e9s ne seront pas d\u00e9molies. [Mostafa Alkharouf – Anadolu Agency]<\/p><\/div>L’audience s’est d\u00e9roul\u00e9e devant un panel de trois juges – Yitzhak Amit, Noam Sohlberg et Daphne Barak-Erez – qui se pronon\u00e7aient sur la demande d’autorisation de l\u2019appel soumis par les familles El-Kurd, Jaouni, Abu Hasna et Askafi qui risquent d’\u00eatre expuls\u00e9es de leurs maisons \u00e0 Sheikh Jarrah par l\u2019association de colons Nahalat Shimon.<\/p>\n

Les deux parties ont ensuite pr\u00e9sent\u00e9 leurs arguments, et l’audience s’est termin\u00e9e sans qu’une d\u00e9cision de justice soit rendue. Les juges devraient rendre une d\u00e9cision dans les prochains jours concernant la poursuite de la proc\u00e9dure. Selon l’un des avocats repr\u00e9sentant les familles, une nouvelle audience sur la question sera probablement programm\u00e9e. Initialement pr\u00e9vue pour le d\u00e9but du mois de mai, l’audience a \u00e9t\u00e9 report\u00e9e\u00a0jusqu’\u00e0 maintenant pour permettre au procureur g\u00e9n\u00e9ral de d\u00e9cider s\u2019il interviendrait dans l’affaire, ce qu’il a finalement refus\u00e9<\/a>.<\/p>\n

La d\u00e9cision du tribunal, dans cette affaire, aura probablement un impact sur les autres familles du quartier Kerem Al-Jaouni de Sheikh Jarrah qui font l’objet de poursuites pour expulsion intent\u00e9es par Nahalat Shimon, y compris le cas des familles Dajani, Daoudi et Hammad, \u00e9galement en instance devant la Cour supr\u00eame.<\/p>\n

Le 28 juillet, l’avocat repr\u00e9sentant les trois familles susmentionn\u00e9es a pr\u00e9sent\u00e9 une demande de report de la date d’expulsion pr\u00e9vue pour hier.<\/p>\n

En r\u00e9ponse, la Cour supr\u00eame a \u00e9mis une injonction temporaire, gelant provisoirement leur expulsion et demandant au groupe de colons de r\u00e9pondre avant le 8 ao\u00fbt. Les trois familles ont \u00e9galement d\u00e9pos\u00e9 une demande d’autorisation d’appel aupr\u00e8s de la Cour supr\u00eame, mais aucune audience n’a \u00e9t\u00e9 programm\u00e9e et aucune d\u00e9cision n’a \u00e9t\u00e9 rendue.<\/p>\n

\u00c0 l’heure actuelle, des poursuites pour expulsion sont en cours contre un total d’environ 50 \u00e0 60 familles \u00e0 Sheikh Jarrah (30 familles – section Kerem Al-Jaouni et 20 \u00e0 30 familles – section Um Haroun), \u00e0 diff\u00e9rents stades de la proc\u00e9dure judiciaire.<\/p>\n

De nombreuses autres familles risquent de recevoir des demandes d’expulsion en raison des proc\u00e9dures d’enregistrement cadastral que les autorit\u00e9s isra\u00e9liennes ont sournoisement entam\u00e9es \u00e0 J\u00e9rusalem-Est occup\u00e9e en 2020 pour la premi\u00e8re fois depuis 1967.<\/p>\n

\u00ab\u00a0\u00c0 l’insu du public, les autorit\u00e9s ont discr\u00e8tement enregistr\u00e9 les droits fonciers de propri\u00e9t\u00e9s \u00e0 Um Haroun au profit de pr\u00e9tendus propri\u00e9taires juifs. Une telle d\u00e9marche est sans pr\u00e9c\u00e9dent et pourrait avoir des r\u00e9percussions graves sur les propri\u00e9t\u00e9s palestiniennes, non seulement \u00e0 Sheikh Jarrah mais dans tout J\u00e9rusalem-Est<\/em>\u00ab\u00a0, a d\u00e9clar\u00e9 le groupe isra\u00e9lien de d\u00e9fense des droits Ir Amim <\/a>sur son site Internet, \u00ab\u00a0ce qui pourrait finalement conduire \u00e0 une d\u00e9possession palestinienne g\u00e9n\u00e9ralis\u00e9e dans la ville et \u00e0 l’expansion de la colonisation juive<\/em>.\u00a0\u00bb<\/p>\n
